Human Rights Law Practice

 

 

Law Practice consists of legal services offered for individuals and legal persons (including non non-profit organizations) to address violations of human rights under ECHR provisions such as: property right, the right to a fair trial, right to private and family life, the right to liberty and security, the prevention of torture, etc. The aim is to protect a wide range of human rights at all levels of domestic courts and at the European Court of Human Rights. 01.

The right to a fair trial

The right to a fair ltrial applies:

 

In the civil field when the individual proves that there has been a judicial or quasi-judicial dispute over the resolution of civil rights or obligations that are explitly provided for in the law.

 

In the criminal field, it applies immediately as soon as an individual is charged with a criminal offense until the resolution of charges at all levels of the trial.

 

The purpose of this right is to guarantee every person :

 

(1) for fairness of civil and criminal proceedings

 

(2) to have access to court for the determination of civil rights or obligations

 

(3) to execute a final civil judicial decision.

The property right

 

The right to property applies:

 

(1) to every natural or legal person to protect the peaceful enjoyment of his possessions

 

(2) to challenge any interference for the deprivation of possessions, except where the State acts in the defense of the public interest or subject to conditions provided by law.

(3) to challenge the state's control over the use of property, except where the State acts in accordance to the general interest or  to secure payment of taxes or other contributions or penalties.

Liberty and security

 

 

 

The right to liberty and security applies:

​

 

(1) to the arbitrary and unlawful deprivation of a persons' liberty 

 

(2) failure to promptly  inform a person of the reasons of his arrest or any charge brought against him

​

(3) failure to bring an arrested person promptly before a judge and release a trial within a reasonable time

 

(4) failure to ensure to an arrested or detained person the right for judicial review of his detention

​

 (5) failure to provide compensation to anyone who has been a victim of unlawful detention.

Respect to private and family life

The right to family and private life includes four spheres of personal autonomy such as private life, family life, home, and correspondence.

 

The private sphere includes the individual's protection of (1) physical, psychological and moral integrity (2) privacy and (3) identity.

 

Protecting an individual's family life implies respect for the right to be a parent, the right to children, or material interests.

 

Protection of a person's home means prohibition of (1) harmful or life-threatening pollution (2) natural hazards (3) acoustic pollution, (4) destruction (5) expulsion of  displaced persons (6) coercive entry of police officers etc.

 

Protecting correspondence of an individual means respecting the privacy of  letters, telephone conversations, emails, private radio or messages.
