04. Other absolute and derogatory rights

Some violations of absolute rights may occur in the following forms:

  • Lack of precision in legislation on life-saving projections in the context of health protection, hazardous activities, ship boarding, road safety, medical care in state institutes

  • the lack of protection by the state for the loss of a persons' life coming from the foreseeable risks of imprisonment, domestic violence, the assassination of witnesses, murder in conflict zones etc.

  • protection by the state when there is a risk of personal self-injury such as suicide in prisons, pre-trial detention, military service, psychiatric hospitals etc.

  • prohibition of forced labor

  • violation of the principle of the lack of retroactive effect of criminal law  in detriment of the interested person

There are also other violations of derogatory rights

  • the violation of the right of expression

  • the violation of freedom of thought, conscience and faith

  • the violation of the right to non-discrimination on grounds of sex, race, religion, ethnicity, etc.

  • the violation of the right to education by changing the admission criteria

  • the violation of the right to education for persons with disabilities, vulnerable persons, prisoners, etc.

  • the violation of the right to free elections
